This book explores the various connections between Law and Opera, providing a comprehensive, multinational, and multidisciplinary resource on the subject. Further, it makes a valuable contribution to studies on law and the humanities. While, for example, the relationship between law and literature has been extensively researched, the relationship between Law and Opera remains largely overlooked. The book approaches the topic from three perspectives in three main sections: Law in Opera, Law on Opera, and Law around Opera.

At present, there is a number of extinct species, which we understand to be related to human evolution, demonstrating that the Darwin’s prediction was correct: light has been thrown, indeed. Friendship is commonly assumed to reduce strategic uncertainty and enhance tacit coordination. However, this assumption has never been tested across two opposite poles of coordination involving either strategic complementarity or substitutability. We had participants interact with friends or strangers in two classic coordination games: the stag-hunt game, which exhibits strategic complementarity and may foster “cooperation”, and the entry game, which exhibits strategic substitutability and may foster “competition”. Both games capture a frequent trade-off between a potentially high paying but uncertain option (...) and a low paying but safe alternative. We find that, relative to strangers, friends are more likely to choose options involving uncertainty in stag-hunt games, but the opposite is true in entry games. Furthermore, in stag-hunt games, friends “tremble” less between options, coordinate better and earn more, but these advantages are largely decreased or lost in entry games. We further investigate how these effects are modulated by risk attitudes, friendship qualities, and interpersonal similarities. (shrink)

The informed consent process is the legal embodiment of the fundamental right of the individual to make decisions affecting his or her health., and the patient’s permission is a crucial form of respect of freedom and dignity, it becomes extremely important to enhance the patient’s understanding and recall of the information given by the physician. This statement acquires additional weight when the medical treatment proposed can potentially be detrimental or even fatal. This is the case of thalassemia patients pertaining to (...) class 3 of the Pesaro classification where Allogenic hematopoietic stem cell transplantation remains the only potentially curative treatment. Unfortunately, this kind of intervention is burdened by an elevated transplantation-related mortality risk , equal to 30% according to published reports. In thalassemia, the role of the patient in the informed consent process leading up to HSCT has not been fully investigated. This study investigated the hypothesis that information provided by physicians in the medical scenario of HSCT is not fully understood by patients and that misunderstanding and communication biases may affect the clinical decision-making process. A dificuldade desse diagnóstico está na razão de que, para muitos, a ditadura militar ocorrida em solo brasileiro se aproxima do não-Ser de Parmênides: impensável e indizível, algo que simplesmente deve ser esquecido. Mas como reconciliar-se com o nosso passado e construir bases sólidas de (...) uma nova democracia se não falamos e refletimos sobre nossas mazelas fomentadas, fundamentalmente, em “nossos campos”, nos porões dos DOPS? O presente artigo tem como objetivo refletir acerca de algumas características constitutivas da ditadura militar brasileira, transcorrida entre os anos de 1964 a 1988, balizada pelos conceitos de estado de exceção, vida nua e campo do filósofo italiano Giorgio Agamben. A pesquisa se justifica, uma vez que, em nosso entendimento, aproximar a ditadura militar brasileira com tópicas da filosofia política de Agamben, nos dota de importantes ferramentas argumentativas que nos auxiliam na compreensão do que se passou no Brasil em seus “anos de chumbo”.: Some political events passed in the recent past of a nation, as a military dictatorship, which lasted for twenty-four years, produce aparently invisible sequels, with symptoms whose origin is difficult to be diagnosed. The difficulty of this diagnosis is the reason that, for many, the military dictatorship that took place on Brazilian soil approaches the not-Being of Parmenides: unthinkable and unspeakable, something that should just be forgotten. But how to reconcile with our past and build solid foundations of a new democracy if we do not talk and reflect on our ills fostered mainly on "our fields", the holds of the Departments of Political and Social Order? This article aims to reflect on some constitutive features of the Brazilian military dictatorship, elapsed between the years 1964 to 1988, buoyed by the state of emergency concepts, bare life and field of the Italian philosopher Giorgio Agamben. The research is justified since, in our view, approaching the Brazilian military dictatorship with topical political philosophy of Agamben, endows us with important argumentative tools that help us understand what happened in Brazil in his "years of lead". O objetivo deste artigo é fazer uma leitura foucaultiana sobre esses posicionamentos. Nossa proposta se fundamenta em três momentos: uma análise do conceito de _biopolítica _a partir dos cursos de Foucault no Collège de France; em seguida fazemos uma análise das intervenções de Agamben e de Esposito à luz de suas propostas de _biopolítica_; por fim, tais leituras serão (...) movimentadas a partir de propostas metodológicas que dão preferência à “um uso” dos textos de Foucault na perspectiva da “caixa de ferramentas” e dos “textos-bombas”, realizando uma leitura que se apoia no potencial crítico das formulações do filósofo francês. This contribution proposes how beholders may internally process unfinished works of art. It does so by considering five of Michelangelo Buonarroti’s interrupted sculptures and pointing out their empathic and imaginative potential. The beholder focused on the surface, I propose, is inclined to mentally simulate the artist’s gesture that drafted the sculptures through the visible graphic signs of the chisels. This inner simulation takes place within the activation of various brain networks, located in the brain’s motor system. Renaissance authors associated the (...) observation of the unfinished to learning and, as this article shows, this assumption seems to find confirmation in recent neuroscientific studies on mirror neurons and imitation learning. In this way, the empathic engagement established between the beholder and the work of art observed – as well as the role played by embodied simulation and imagination in this kind of visual perception – clarifies how the incompleteness can also have that pedagogical function recognised by Giorgio Vasari and Benvenuto Cellini. According to a growing trend in theoretical neuroscience, the human perceptual system is akin to a Bayesian machine. The aim of this article is to clearly articulate the claims that perception can be considered Bayesian inference and that the brain can be considered a Bayesian machine, some of the epistemological challenges to these claims; and some of the implications of these claims. We address two questions: (i) How are Bayesian models used in theoretical neuroscience? (ii) From the use of Bayesian (...) models in theoretical neuroscience, have we learned or can we hope to learn that perception is Bayesian inference or that the brain is a Bayesian machine? From actual practice in theoretical neuroscience, we argue for three claims. First, currently Bayesian models do not provide mechanistic explanations; instead they are useful devices for predicting and systematizing observational statements about people's performances in a variety of perceptual tasks. That is, currently we should have an instrumentalist attitude towards Bayesian models in neuroscience. Second, the inference typically drawn from Bayesian behavioural performance in a variety of perceptual tasks to underlying Bayesian mechanisms should be understood within the three-level framework laid out by David Marr ( [1982] ). Third, we can hope to learn that perception is Bayesian inference or that the brain is a Bayesian machine to the extent that Bayesian models will prove successful in yielding secure and informative predictions of both subjects' perceptual performance and features of the underlying neural mechanisms. It is often claimed that the greatest value of the Bayesian framework in cognitive science consists in its unifying power. Several Bayesian cognitive scientists assume that unification is obviously linked to explanatory power. But this link is not obvious, as unification in science is a heterogeneous notion, which may have little to do with explanation. While a crucial feature of most adequate explanations in cognitive science is that they reveal aspects of the causal mechanism that produces the phenomenon to be (...) explained, the kind of unification afforded by the Bayesian framework to cognitive science does not necessarily reveal aspects of a mechanism. In a recent paper, Pruss proves the validity of the rule beta-2 relative to Lewis’s semantics for counterfactuals, which is a significant step forward in the debate about the consequence argument. Yet, we believe there remain intuitive counter-examples to beta-2 formulated with the actuality operator and rigidified descriptions. We offer a novel and two-dimensional formulation of the Lewisian semantics for counterfactuals and prove the validity of a new transfer rule according to which a new version of the consequence argument can (...) be formulated. This new transfer rule is immune to the counter-examples involving the actuality operator and rigidified descriptions. However, we show that counter-examples to this new rule can also be generated, demanding that the Lewisian semantics be generalized for higher dimensions where counter-examples can always be generated. Focused on city-scale automation, and using self-driving cars (SDCs) as a case study, this article reflects on the role of AI—and in particular, computer vision systems used for mapping and navigation—as a catalyst for urban transformation. Urban research commonly presents AI and cities as having a one-way cause-and-effect relationship, giving undue weight to AI’s impact on cities and overlooking the role of cities in shaping AI. Working at the intersection of data science and social research, this paper aims to counter (...) this trend by exploring the reverse perspective: how do cities affect the development, and expose the present limits, of SDCs? The contribution of this paper is threefold. First, by comparing urban and nonurban environments and thoroughly examining the relationship between computer vision and city-specific sociality and form, it defines machine autonomy/automation as a function of the sociotechnical milieu in which an AI system operates. Second, and related, the paper problematizes the notion of SDCs as autonomous technologies and the role it plays in envisioning contending policy arrangements and technical solutions for achieving full driving automation. Finally, the article offers insight into a materialist and spatialized understanding of AI—namely, not as an abstract quality susceptible to replication within discrete machines, but rather as a distributed property emerging through embodied interactions among a multiplicity of agents (human, non-human, and technological) within/with their environments. Populism is widely thought to be in tension with liberal democracy. This article clarifies what exactly is problematic about populism from a liberal–democratic point of view and goes on to develop normative standards that allow us to distinguish between more and less legitimate forms of populism. The point of this exercise is not to dismiss populism in toto; the article strives for a more subtle result, namely, to show that liberal democracy can accommodate populism provided that the latter conforms to (...) particular discursive norms. What the article calls a ‘liberal ethics of populism’ turns out to be closely bound up with a broader ethics of peoplehood, understood as a way of articulating who ‘the people’ are in a way that is compatible with liberal–democratic principles of political justification. Such an ethics, concludes the article, inevitably has a much wider audience than populist political actors: its addressees are all those who seek legitimately to exercise power in the name of the people. In a recent article, P. Roger Turner and Justin Capes argue that no one is, or ever was, even partly morally responsible for certain world-indexed truths. Here we present our reasons for thinking that their argument is unsound: It depends on the premise that possible worlds are maximally consistent states of affairs, which is, under plausible assumptions concerning states of affairs, demonstrably false. Our argument to show this is based on Bertrand Russell’s original ‘paradox of propositions’. We should then opt (...) for a different approach to explain world-indexed truths whose upshot is that we may be morally responsible for some of them. The result to the effect that there are no maximally consistent states of affairs is independently interesting though, since this notion motivates an account of the nature of possible worlds in the metaphysics of modality. We also register in this article, independently of our response to Turner and Capes, and in the spirit of Russell’s aforementioned paradox and many other versions thereof, a proof of the claim that there is no set of all true propositions one can render false. The present work refers to the doctorship research that implemented the Free-Expression Painting Studio technique to assist university students who had suicidal ideations or attempts. This technique was developed in France by the psychologist Michel Ternoy, based on Minkowski’s structural-phenomenon analysis method. A group session will be presented and discussed from Michel Henry’s phenomenology of life. Psychology and phenomenology can create spaces for belonging and support, which allow the transformation of suffering from experiences in the community. The Painting Studio makes (...) it possible to experience the affection of the other as a potential of one’s own possibilities, mobilizing the affective dialectical relationship, through which one can go from unbearable suffering to original fruition. We seek to show that art can be part of the therapeutic process as an alternative to the passage to the act of suicide before it becomes unbearable. (shrink)

It is a widely held principle that no one is able to do something that would require the past to have been different from how it actually is. This principle of the fixity of the past has been presented in numerous ways, playing a crucial role in arguments for logical and theological fatalism, and for the incompatibility of causal determinism and the ability to do otherwise. I will argue that, assuming bivalence, this principle is in conflict with standard views about (...) knowledge and the semantics for ‘actually’. Populist movements have become key players in European politics. These movements are readily criticized by journalists or political rivals, yet none of the common objections to populism seems to arrest their success. This article turns to normative political theory to cultivate sensitivity to problems arising from some existing arguments against populism, and to explore possible alternatives. It offers a critical reading of prototypical liberal and conservative arguments against populism, and proposes that the principles of solidarity and procedure provide good grounds (...) for a sustainable critique of populism. Popular sovereignty requires that citizens perceive themselves as being able to act and implement decisions, and that they are de facto causally connected to mechanisms of decision making. I argue that the two most common understandings of the exercise of popular sovereignty—which center on direct decision making by the people as a whole and the indirect exercise of democratic agency by elected representatives, respectively—are inadequate in this respect, and go on to suggest a complementary account that stresses the central role (...) of internally democratic and participatory political parties in actualising popular sovereignty, drawing on the democratic theory of Hans Kelsen. I discuss the two volumes by focusing on three broader and (...) interconnected themes: the problem that constructivism is meant to respond to, the tendency of representation theorists to expand the possibilities of representation as broadly as possible, and the normative aspects of political representation and how constructivists deal with them. Evolutionary Debunking Arguments are defined as arguments that appeal to the evolutionary genealogy of our beliefs to undermine their justification. Recently, Helen De Cruz and her co-authors supported the view that EDAs are self-defeating: if EDAs claim that human arguments are not justified, because the evolutionary origin of the beliefs which figure in such arguments undermines those beliefs, and EDAs themselves are human arguments, then EDAs are not justified, and we should not accept their conclusions about the fact that human (...) arguments are unjustified. De Cruz's objection to EDAs is similar to the objection raised by Reuben Hersh against the claim that, since by Gödel's second incompleteness theorem the purpose of mathematical logic to give a secure foundation for mathematics cannot be achieved, mathematics cannot be said to be absolutely certain. The response given by Carlo Cellucci to Hersh's objection shows that the claim that by Gödel's results mathematics cannot be said to be absolutely certain is not self-defeating, and can be adopted to show that EDAs are not self-defeating as well in a twofold sense: an argument analogous to Cellucci's one may be developed to face De Cruz's objection, and such argument may be further refined incorporating Cellucci's response itself in it, to make it stronger. This paper aims at showing that the accusation of being self-defeating moved against EDAs is inadequate by elaborating an argument which can be considered an EDA and which can also be shown not to be self-defeating. Several theists, including Linda Zagzebski, have claimed that theism is somehow committed to nonvacuism about counterpossibles. Even though Zagzebski herself has rejected vacuism, she has offered an argument in favour of it, which Edward Wierenga has defended as providing strong support for vacuism that is independent of the orthodox semantics for counterfactuals, mainly developed by David Lewis and Robert Stalnaker. In this paper I show that argument to be sound only relative to the orthodox semantics, which entails vacuism, and give (...) an example of a semantics for counterfactuals countenancing impossible worlds for which it fails. We present recent results on the model companions of set theory, placing them in the context of a current debate in the philosophy of mathematics. We start by describing the dependence of the notion of model companionship on the signature, and then we analyze this dependence in the specific case of set theory. We argue that the most natural model companions of set theory describe (as the signature in which we axiomatize set theory varies) theories of $H_{\kappa ^+}$, as $\kappa (...) $ ranges among the infinite cardinals. We also single out $2^{\aleph _0}=\aleph _2$ as the unique solution of the continuum problem which can (and does) belong to some model companion of set theory (enriched with large cardinal axioms). While doing so we bring to light that set theory enriched by large cardinal axioms in the range of supercompactness has as its model companion (with respect to its first order axiomatization in certain natural signatures) the theory of $H_{\aleph _2}$ as given by a strong form of Woodin’s axiom $(*)$ (which holds assuming $\mathsf {MM}^{++}$ ). Finally this model-theoretic approach to set-theoretic validities is explained and justified in terms of a form of maximality inspired by Hilbert’s axiom of completeness. (shrink)

In this paper we present tableau methods for two-dimensional modal logics. Although models for such logics are well known, proof systems remain rather unexplored as most of their developments have been purely axiomatic. The logics herein considered contain first-order quantifiers with identity, and all the formulas in the language are doubly-indexed in the proof systems, with the upper indices intuitively representing the actual or reference worlds, and the lower indices representing worlds of evaluation—first and second dimensions, respectively. The tableaux modulate (...) over different notions of validity such as local, general, and diagonal, besides being general enough for several two-dimensional logics proposed in the literature. We also motivate the introduction of a new operator into two-dimensional languages and explore some of the philosophical questions raised by it concerning the relations there are between actuality, necessity, and the a priori, that seem to undermine traditional intuitive interpretations of two-dimensional operators. Solidarity can be conceived in multiple ways. This article probes possible underlying ontological and normative assumptions of solidarity. In order to conceptually clarify the notion of solidarity, we distinguish between five types of solidarity. We suggest that solidarity is either grounded in the Enlightenment ideas of liberty, or a category of loyalty and allegiance. If the former is the case, solidarity can be justified on rational grounds. If the latter is the case, it is contingent on narratives of historical continuity (...) and a non-rational sense of belonging. Moreover, we show that different types of solidarity can be derived from Anglo-Saxon and continental thought, which hints at different conceptions of community. (shrink)

Why has power in the West assumed the form of an "economy," that is, of a government of men and things? If power is essentially government, why does it need glory, that is, the ceremonial and liturgical apparatus that has always accompanied it? In the early centuries of the Church, in order to reconcile monotheism with God's threefold nature, the doctrine of Trinity was introduced in the guise of an economy of divine life. It was as if the Trinity amounted (...) to nothing more than a problem of managing and governing the heavenly house and the world. Agamben shows that, when combined with the idea of providence, this theological-economic paradigm unexpectedly lies at the origin of many of the most important categories of modern politics, from the democratic theory of the division of powers to the strategic doctrine of collateral damage, from the invisible hand of Smith's liberalism to ideas of order and security. But the greatest novelty to emerge from _The Kingdom and the Glory _ is that modern power is not only government but also glory, and that the ceremonial, liturgical, and acclamatory aspects that we have regarded as vestiges of the past actually constitute the basis of Western power. Through a fascinating analysis of liturgical acclamations and ceremonial symbols of power—the throne, the crown, purple cloth, the Fasces, and more—Agamben develops an original genealogy that illuminates the startling function of consent and of the media in modern democracies. A hipótese é que a discussão a respeito da consciência histórica (...) passou a se ocupar, na modernidade, com uma múltipla relatividade de pontos de vista, o que é destacado por Gadamer em sua análise sobre os preceitos implicados na definição do que significa “ter senso histórico”. É defendida a tese, portanto, de que a noção de consciência histórica não se limita ao conhecimento das experiências vivenciadas no passado, mas se apresenta como condição de possibilidade de projetar o futuro e se posicionar em relação ao passado, especialmente no que diz respeito às ciências humanas e sociais. A defesa desta ideia central é realizada por meio de dois gestos reflexivos, com apresentação, primeiramente, do marco teórico da consciência histórica e, posteriormente, de suas implicações na constituição das Ciências Humanas e Sociais. Implications of the notion of historical consciousness in human and social sciences: a mode of projection for the future and position in relation to the past: This bibliographic text discusses the problem of historical consciousness with the purpose of thinking about the meaning of this expression in the present time and the variations that this concept has acquired throughout the history of the Humanities and Social Sciences, with emphasis on the twentieth century. The hypothesis is that the discussion about historical consciousness has come to concern itself, in modernity, with a multiple relativity of points of view, which is highlighted by Gadamer in his analysis of the precepts involved in defining what “having a historical sense” means. Therefore, the thesis that the notion of historical consciousness is not limited to the knowledge of past experiences is defended, but is presented as a condition of possibility of projecting the future and positioning itself in relation to the past, especially with regard to humanities and social sciences. The defense of this central idea is made through two reflexive gestures, presenting, first, the theoretical framework of historical consciousness and, later, its implications in the constitution of the Human and Social Sciences. La hipótesis es que la discusión sobre la conciencia histórica ha llegado a ocuparse, en la modernidad, de una relatividad múltiple de puntos de vista, que Gadamer destaca en su análisis de los preceptos involucrados en la definición de lo que significa “tener un sentido histórico”. We present a new puzzle about logical truth, necessity, and moral responsibility. We defend one solution to the puzzle. A corollary of our preferred solution is that prominent arguments for the incompatibility of determinism and moral responsibility are invalid.

Predicates such as tall or to know Latin, which intuitively denote permanent properties, are called individual-level predicates. Many peculiar properties of this class of predicates have been noted in the literature. One such property is that we cannot say #John is sometimes tall. Here is a way to account for this property: this sentence sounds odd because it triggers the scalar implicature that the alternative John is always tall is false, which cannot be, given that, if John is sometimes tall, (...) then he always is. This intuition faces two challenges. First: this scalar implicature has a weird nature, since it must be surprisingly robust (otherwise, it could be cancelled and the sentence rescued) and furthermore blind to the common knowledge that tallness is a permanent property (since this piece of common knowledge makes the two alternatives equivalent). Second: it is not clear how this intuition could be extended to other, more complicated properties of individual-level predicates. The goal of this paper is to defend the idea of an implicature-based theory of individual-level predicates by facing these two challenges. In the first part of the paper, I try to make sense of the weird nature of these special mismatching implicatures within the recent grammatical framework for scalar implicatures of Chierchia (Structures and beyond, 2004) and Fox (2007). In the second part of the paper, I show how this implicature-based line of reasoning can be extended to more complicated properties of individual-level predicates, such as restrictions on the interpretation of their bare plural subjects, noted in Carlson (Reference to kinds in English. Doctoral dissertation, University of Massachusetts at Amherst, 1977), Milsark (Linguistic Analysis 3.1: 1–29, 1977), and Fox (Natural Language Semantics 3: 283–341, 1995); restrictions on German word order, noted in Diesing (Indefinites, 1992); and restrictions on Q-adverbs, noted in Kratzer (The Generic Book, ed. RESUMO: O objetivo deste artigo é examinar o que entendemos ser uma prova original da existência de Deus na obra de Pierre Duhem. Cremos que a originalidade dessa prova consiste especialmente nas premissas usadas pelo filósofo. Quanto à forma, a mesma assemelha-se ao conhecido argumento do desígnio, mas a sua versão se caracteriza por buscar na história das teorias físicas a matéria da qual a existência de uma Providência é derivada. É a complexa evolução das teorias e, a despeito dela, (...) a sua espantosa progressividade em direção a estágios sempre mais perfeitos que servem de premissa para a via duhemiana de acesso a Deus. Tudo se passa como se houvesse uma suposta pré-ordenação divina do curso das teorias, uma finalidade intrínseca a ele. ABSTRACT: The aim of this paper is to examine what we believe to be an original proof of the existence of God in the work of Pierre Duhem. We think that the originality of this proof consists especially in the assumptions used by the French philosopher in his argumentation. Internal misconduct is a universal problem in prisons and affects the maintenance of social order. Consequently, correctional institutions often develop rehabilitation programs to reduce the likelihood of inmates committing internal offenses and criminal recidivism after release. Therefore, it is necessary to identify the profile of each offender, both for the appropriate indication of a rehabilitation program and the level of internal security to which he must be submitted. In this context, this work aims to discover the most significant characteristics in (...) predicting inmate misconduct from ML methods and the SHAP approach. A database produced in 2004 through the Survey of Inmates in State and Federal Correctional Facilities in the United States of America was used, which provides nationally representative data on prisoners from state and federal facilities. The predictive model based on Random Forest performed the best, thus, we applied the SHAP to it. Overall, the results showed that features related to victimization, type of crime committed, age and age at first arrest, history of association with criminal groups, education, and drug and alcohol use are most relevant in predicting internal misconduct. Thus, it is expected to contribute to the prior classification of an inmate on time, to use programs and practices that aim to improve the lives of offenders, their reintegration into society, and consequently, the reduction of criminal recidivism.
